General Sales Conditions

Placing an order implies acceptance of the following general sales conditions:

ORDERS:

Orders for standard and special equipment are binding upon the customer. Once production has commenced, no cancellations or modifications to the order will be accepted. Orders must be placed via fax or email.

PRICES:

Prices are subject to change without prior notice, as are the details contained in this catalog. Information, photos, diagrams, or colors provided are indicative and may be subject to change without notice. Despite our best efforts, errors in pricing may occur; please contact us for verification.

DELIVERY TIMES:

Delivery times are provided for guidance only and are not binding. Failure to meet these deadlines does not entitle the customer to cancel the order or seek a refund.

DELIVERY:

Goods are delivered ex works. Risk passes to the buyer upon delivery. The buyer must note any packaging or merchandise defects on the delivery receipt. Any claims must be made within 24 hours of receiving the shipment. Packaging costs are included in the shipping fees. The buyer must specify the preferred carrier for the shipment when placing the order. Otherwise, Evotech-moto will use its usual carrier and invoice the shipping costs to the buyer.

PAYMENT:

Payments must be made according to the terms stated on the sales invoice. In case of late payment, Evotech-moto reserves the right to suspend deliveries of current orders and/or demand advance payment for new orders.

OWNERSHIP RESERVATION CLAUSE:

In accordance with Law 90,335 of May 12, 1980, we reserve ownership of the goods until full payment of the relevant invoices. In case of partial or total non-payment by the due date, we reserve the right to repossess the products. In case of dispute, the Commercial Court of La Roche sur Yon shall have sole jurisdiction.

WARRANTY:

Products are warranted against manufacturing defects by our suppliers for 2 years from the date of acquisition. In the event of defective products purchased directly from Evotech-moto, the customer must inform Evotech-moto in writing beforehand. Any return of merchandise is at the customer's expense. Warranty acceptance is subject to analysis and approval by our supplier. Only approved exhaust systems are covered by a 2-year warranty. Removing or disassembling components from these exhausts voids the warranty. Racing exhausts are not covered due to their intended use.

In accordance with the provisions of Article L 121-20 of the French Consumer Code, you have 14 working days (instead of the seven full days provided for by law) to return a product that does not meet your expectations (for more information, refer to Ordinance No. 2001 of August 23, 2001, Articles 5 and 12 of the Official Journal of August 25, 2001). Within this period, you may return the product at your own expense, accompanied by your invoice. Only products that are new and complete (accessories, packaging, manuals, etc.), returned in their original packaging, undamaged, unmarked, and not taped (i.e., also in new condition), will be accepted.

LIABILITY:

Evotech-moto disclaims all liability for improper use of the items sold. It also disclaims liability for physical, moral, or material damages to any entity due to improper use, applications, or incorrect installations. Some products sold by Evotech-moto are not approved for road use and are only intended for private, circuit, or event purposes. Approved products are clearly identified upon delivery and on the items themselves. Some products do not comply with regulations for public road use; customers should consult applicable laws.
